In accordance with the above table, the parties hereby formalize this RENTAL AGREEMENT in accordance with the following:
TERMS AND CONDITIONS
FIRST.- Through this contract, EMOVEYOU leases to the CUSTOMER the BICYCLE(S) and/or MOTORCYCLE(S) identified above (hereinafter, the "BICYCLE(S)" and/or "MOTORCYCLE(S)") and the safety items and/or accessories (hereinafter, the "ACCESSORIES"), which the CUSTOMER declares to have received in accordance with the contract. The specifications and condition of the BICYCLE(S) and/or MOTORCYCLE(S) and the ACCESSORIES are listed in the table above.
SECOND.- The rental period shall be as specified in the table above. At the end of the term, the CUSTOMER must return the bicycle and ACCESSORIES in the same condition in which they were delivered by EMOVEYOU. Billing will be based on 24-hour periods, counted from the time the contract was formalized. There is a grace period of 59 minutes, after which an additional day's rental will be charged. No refund will be made for returns before the time stipulated in the contract.
THIRD.- The BICYCLE(S) and/or MOTORCYCLE(S) and, where applicable, the ACCESSORIES are delivered in perfect working order and must be returned complete and in the same condition in which they were delivered to the CUSTOMER. The cost of repairing or replacing the BICYCLE(S) and/or MOTORCYCLE(S) or ACCESSORIES shall be borne by the customer. The CUSTOMER must inform us upon delivery of the bicycle of any damage to said equipment or its malfunction. Please take care and take all necessary precautions to protect the bicycles and equipment from damage, loss, or theft. The CUSTOMER will immediately assume all costs of repair or replacement of the rented products.
FOURTH.- THE CUSTOMER undertakes to take good care and take all necessary precautions to protect the rented Bicycle and ACCESSORIES from damage, loss, or theft.
FIFTH.- The CUSTOMER agrees to use and ride the Bicycle in accordance with basic riding and traffic rules, and will be personally liable for any damage or loss suffered by the BICYCLE(S) and/or MOTORCYCLE(S) and their ACCESSORIES, such as tools, wheels, locks, etc., due to their negligence. Likewise, the CUSTOMER is expressly prohibited from selling, renting, transferring, or mortgaging any item belonging to the rented vehicle.
SIXTH.- While the Bicycle is in the possession of THE CUSTOMER, the latter shall be responsible for:
a) Damage caused by the Bicycle to third parties while it is in your possession;
b) For damage caused by the Bicycle to property or persons transported therein while the vehicle is in your possession;
c) For all traffic violations committed while the vehicle is in your possession.
For the events described in this section or any other that may arise from the use of the bicycle by THE CUSTOMER, the latter undertakes to hold EMOVEYOU harmless and, consequently, EXEMPTS EMOVEYOU FROM LIABILITY, and may call upon EMOVEYOU to act as guarantor in the event that EMOVEYOU is sued.
SEVENTH.- The return of the BICYCLE(S) and/or MOTORCYCLE(S) and ACCESSORIES rented shall be made in the same condition in which they were received, at the place or establishment indicated in the table. In this way, THE CUSTOMER will be liable for any damage caused to the BICYCLE(S) and/or MOTORBIKE(S) and the ACCESSORIES delivered with them, authorizing THE CUSTOMER to deduct the cost of repair or replacement from the sum that was delivered as a deposit. If the cost of the damage exceeds the amount of the deposit, the remaining amount will be charged directly to the credit card. In the event that EMOVEYOU has to deal with any of the situations described in the previous section, THE CUSTOMER expressly agrees that this amount may be charged to their credit card, even after the contract has ended and the vehicle has been returned.
EIGHTH.- THE CUSTOMER shall make a deposit for the amount indicated in the table, in order to cover any damage that may be caused to the BICYCLE(S) and/or MOTORCYCLE(S) and/or ACCESSORIES rented. If none of these events occur, the total value of the deposit will be returned in full upon return of the BICYCLE(S) and/or MOTORCYCLE(S) and/or ACCESSORIES.
NOVENA: Bike rental does not include insurance for damage to the bike itself, so the renter is responsible for any material or personal damage that may occur. It is the responsibility of the customer and their companion(s) to obey Spanish traffic regulations, drive carefully, and respect pedestrians.
TENTH: In the event of a breakdown, EMOVEYOU offers assistance to repair the breakdown or replace the bicycle and/or motorcycle with another in good working order. The conditions of the service are defined in each establishment, which will inform the renter, if there is the possibility of contracting the service separately, of its cost and coverage.
ELEVENTH: In the event that the provision of services involves the need to access personal data, EMOVEYOU, as the data processor, is obliged to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC , and Organic Law 3/2018 of December 5 on the Protection of Personal Data and Guarantee of Digital Rights. The purpose of data processing will be the management of the contractual relationship between the parties, without such data being communicated to third parties except in cases of legal obligation. The data will be kept for the duration of the contractual relationship between the parties and for as long as any liabilities arising from this contract remain. The CUSTOMER may at any time exercise their rights of access, rectification, and deletion of their personal data before EMOVEYOU, as well as request the portability of such data, oppose its processing, and request its limitation, in which case it will only be kept for the exercise or defense of claims. TWELFTH: For the resolution of any dispute arising from this contract, the parties, expressly waiving any other jurisdiction, expressly submit to the Courts and Tribunals of Barcelona and/or Ibiza.
